Terms of Sale for Evosteel

These Terms of Sale govern the purchase and sale of steel materials on Evosteel, a platform where sellers list their steel products and buyers purchase them. By placing an order on Evosteel, you agree to be bound by these terms. Please read them carefully before making any transactions.

1. Scope

These Terms of Sale apply to all transactions between buyers and sellers on Evosteel. Evosteel provides the platform but does not directly sell or buy any products. The contract for the sale of goods is formed between the seller and the buyer, with Evosteel serving as a facilitator.

2. Product Listings

Accuracy of Listings:

Sellers are responsible for providing accurate and complete information regarding their steel materials, including product specifications, quantities, pricing, and any applicable taxes or shipping fees.

Availability:

While sellers strive to ensure product availability, Evosteel does not guarantee that any item listed on the platform will be available for purchase at all times. If a product becomes unavailable after an order is placed, the seller must notify the buyer and provide options for a refund or alternative solution.

3. Order Process

Placing an Order:

• To place an order on Evosteel, buyers must have a valid account.
• Once an order is placed, the buyer will receive a confirmation email with details of the purchase.

Order Acceptance:

• All orders are subject to acceptance by the seller. Sellers reserve the right to reject an order if the materials are no longer available, if there is a pricing error, or for any other legitimate reason.
• Upon acceptance of the order, the buyer will receive an official order confirmation.

Order Modifications or Cancellations:

• Buyers may request modifications or cancellations before the order is processed by contacting the seller directly. However, sellers are not obligated to accept modification or cancellation requests after the order has been confirmed.

4. Pricing and Payment

Pricing:

• The prices of materials are set by the sellers and are displayed on the product listing page. Prices are subject to change at the seller's discretion but will be fixed at the time the buyer places an order.
• Prices may or may not include applicable taxes and shipping fees, which will be calculated and presented during the checkout process.

Payment Terms:

• Buyers must provide valid payment information at the time of placing an order. Payments are processed securely through a third-party payment provider.
• By placing an order, the buyer authorizes Evosteel or the payment provider to charge the full purchase amount to the provided payment method.
• In cases of payment failure, the buyer's order will not be confirmed, and the buyer will be notified to provide alternative payment details.

5. Shipping and Delivery

Shipping Costs and Methods:

• Shipping costs vary depending on the seller, the buyer's location, and the size or weight of the purchased items. These costs will be presented during checkout.
• Sellers are responsible for arranging shipping and providing the buyer with an estimated delivery date.

Delivery Times:

• While sellers strive to meet the estimated delivery date, delays may occur due to factors beyond their control, such as shipping carrier delays or unforeseen logistical issues.
• Evosteel does not guarantee delivery times and is not responsible for any delays.

Risk of Loss:

• Risk of loss for purchased materials transfers to the buyer once the materials are handed over to the shipping carrier.
• Buyers are encouraged to inspect the materials upon receipt and report any issues immediately.

6. Returns, Refunds, and Disputes

Returns and Refunds:

• Evosteel does not manage return and refund policies. Sellers are required to clearly state their return and refund policies on the product listing page.
• Buyers must contact the seller directly for any return or refund requests and follow the seller's return policy.

Disputes:

• If a buyer is not satisfied with the materials received, or if there is a dispute regarding the transaction, the buyer must first attempt to resolve the issue with the seller.
• If a resolution cannot be reached, the buyer may contact Evosteel's support team for assistance. Evosteel may mediate disputes but is not responsible for resolving them or providing refunds.

7. Title to Goods

Title to the purchased materials passes to the buyer once full payment has been received, and the materials have been handed over to the shipping carrier. Until the buyer has made full payment, the seller retains title to the goods.

8. Seller Responsibilities

Product Quality:

• Sellers are responsible for ensuring that the materials listed for sale meet industry standards and comply with all applicable laws and regulations.
• Sellers must describe the materials accurately and ensure they match the description provided at the time of sale.

Order Fulfillment:

• Sellers are required to process and ship orders within the specified timeframe. Failure to meet delivery deadlines may result in buyer complaints or disputes.

9. Buyer Responsibilities

Inspection of Goods:

• Buyers must inspect the materials upon receipt and notify the seller of any defects, damages, or discrepancies within a reasonable period of time.
• Buyers are responsible for providing accurate delivery information and being available to receive the shipment.

Payment Obligations:

• Buyers agree to pay for the materials in accordance with the terms set out at the time of purchase, including any additional charges for taxes or shipping.

10. Limitation of Liability

To the fullest extent permitted by law, Evosteel and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from the sale, purchase, or use of any materials on the platform. This includes, but is not limited to, loss of profits, loss of data, or business interruptions, even if Evosteel has been advised of the possibility of such damages.

11. Indemnification

Buyers and sellers agree to indemnify and hold harmless Evosteel, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, or expenses arising from:

• The sale or purchase of materials through the platform.
• Any violation of these Terms of Sale.
• Any breach of applicable laws or regulations.

12. Changes to Terms of Sale

Evosteel reserves the right to modify these Terms of Sale at any time. Any updates will be posted on this page, and continued use of the platform after changes are made constitutes acceptance of the revised terms.

13. Governing Law
